These Terms of Service ("Terms") govern your access to and use of the website dibibuns.com and any related services, content and purchases (collectively, the "Service"). The Service is operated by Tom Kenny Mose Larsen, an individual operator located at Nygade 9, 8850 Bjerringbro, Denmark ("dibi buns", "we", "us" or "our"). By accessing the Service or placing an order you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By placing an order you represent and warrant that the information you provide is accurate, complete and current, and that you are authorized to use the payment method you submit.
2. Products
dibi buns sells novelty squishy bao bun toys and related merchandise. Our products are not food and are not edible. They are decorative / novelty items recommended for ages 3 and up and must be kept away from young children who may attempt to ingest them. Product photos, descriptions, weights and colors are provided for illustration; small variations between batches may occur and do not constitute a defect.
Our current catalog (base prices in USD):
- Classic Bao — $15: 1 single slow-rising squishy bao.
- Pastel Trio — $40: 3 baos in cream, peach and matcha.
- Steamer Family Pack — $145: 12 buns nestled in a real bamboo steamer.
3. Orders, Pricing and Acceptance
All prices are displayed in US Dollars (USD) and are exclusive of shipping fees and applicable taxes, which are calculated at checkout. Prices and product availability are subject to change without notice. The display of a product on the Service is an invitation to treat, not an offer. Your order constitutes an offer to purchase, which we may accept or decline. A binding contract is formed only when we send you an order confirmation email.
We reserve the right to refuse or cancel any order at our discretion, including for suspected fraud, pricing errors, stock unavailability, restricted shipping destinations, or violation of these Terms. If we cancel an order after payment we will refund the charged amount in full to the original payment method.
4. Payment
Payments are processed by Stripe Payments Europe, Ltd. and its affiliates ("Stripe"). By paying, you also agree to Stripe's Services Agreement and Privacy Policy. We accept major credit and debit cards (Visa, Mastercard, American Express), Apple Pay, Google Pay and Link, subject to availability in your region. dibi buns does not see, store or process your full card number, CVC or other sensitive payment data. Your card may be subject to authorization checks and fraud screening by Stripe and your card issuer.
5. Shipping and Risk of Loss
Shipping terms, processing times, destinations and rates are described in our Shipping Policy, which is incorporated into these Terms. Title and risk of loss for products pass to you upon delivery to the carrier. You are responsible for providing an accurate shipping address. We are not liable for delays, losses or charges resulting from address errors, refused deliveries, or customs procedures in your country.
6. Returns and Refunds
Returns, refunds and the statutory right of withdrawal applicable to EU/EEA consumers are described in our Refund Policy, which is incorporated into these Terms.
7. Intellectual Property
All content on the Service, including the dibi buns name, logo, product designs, photography, illustrations, text and software, is owned by or licensed to Tom Kenny Mose Larsen and is protected by copyright, trademark and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. Any other use, reproduction or distribution requires our prior written consent.
8. Acceptable Use
You agree not to (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorized access to the Service, its systems or related networks; (c) place fraudulent orders; (d) resell our products in a way that misrepresents their nature or origin; or (e) interfere with the operation of the Service.
9. Disclaimer of Warranties
The Service and our products are provided "as is" and "as available" without warranties of any kind, express or implied, except those that cannot be excluded under applicable mandatory consumer-protection law. To the maximum extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the maximum extent permitted by law, our total aggregate liability arising out of or related to your purchase or use of the Service is limited to the amount you paid us for the product giving rise to the claim. We are not liable for indirect, incidental, special, consequential or punitive damages, or loss of profits, revenue, data or goodwill. Nothing in these Terms limits liability that cannot lawfully be excluded, including liability for fraud, gross negligence, death or personal injury caused by our negligence, or non-conformity rights of EU consumers.
11. Indemnity
You agree to indemnify and hold dibi buns and Tom Kenny Mose Larsen harmless from any third-party claim arising out of your breach of these Terms or your misuse of the Service or products.
12. Privacy
Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms.
13. Changes to the Service or Terms
We may modify the Service, product offerings or these Terms at any time. Updates take effect when posted to dibibuns.com. Material changes will be indicated by updating the "Last updated" date. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of Denmark, without regard to its conflict of laws rules. Mandatory consumer-protection rules of the country where you habitually reside also continue to apply. Disputes shall be brought before the competent courts of Denmark, unless mandatory law allows you to bring the action in the courts of your residence. EU consumers may also access the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
